Your child is a Filipino citizen. Because under the Philippine constitution, a child whose father or mother is a Filipino is considered a natural born Filipino. This is by operation of Philippine law. You did not do anything nor do you need to do anything. However, my understanding of Chinese law is that they do not allow dual citizenship, even if the other citizenship was acquired by operation of law. Of course, your child is qualified to apply for Chinese citizenship because you, as the child's mother, is Chinese. Therefore, the question is how do you convince Chinese government to allow your child to secure Chinese passport and citizenship.
I had a previous case wherein the child of a Filipino father who already abandoned their family, was given a Chinese citizenship upon showing that the child and his Chinese mother are already leaving the Philippines for good in favor of China.
你的孩子是菲律宾公民。因为根据菲律宾宪法，如果父亲或母亲其中一人为菲律宾国籍，那么孩子将是天生的菲律宾人。这是根据菲律宾法律的运作。你什么也没做或者你也不需要做任何事。但是，我对中国法律的理解是他们并不允许双重国籍，即使是另外一个公民身份是通过法律获得的。当然，你的孩子有资格申请中国公民的身份，因为你作为孩子的母亲是中国国籍。所以，问题是，你要如何说服中国政府让你的孩子取得中国护照和公民的身份。
